When the Department for Culture Media Sport (DCMS) recently announced the increase in the maximum AWP prize for “all cash” machines to £35 and the stake to 50p, you may have missed the accompanying new rules in respect of provision of AWP machines.
All these machines as of today, 27th October 2006, must display the Game Care helpline number and have clear signage prohibiting under 18 year olds from playing on the machines. Furthermore the DCMS asserted the need for Licensees to sufficiently supervise the gaming machines to ensure that children are prevented from playing. The DCMS message to the trade is that it must be aware of its social responsibility in respect of gaming machines. Thefts of handbags have been halved by installing Gel Audio talking signs in a successful crime reduction experiment run by the Metropolitan Police in South London. Audible warnings are automatically played to people going into the toilets in pubs and clubs in the Lambeth area reminding them to take care of their belongings.
Gel Audio technology is a new type of speaker system that uses silicone hydro gel material to turn simple flat panels into loud speakers. Gel Audio has been created by SFX Technologies of Dunfermline in Scotland. Gel Audio dramatically reduces the size of speaker required for a desired output and enables a speaker to be easily built into displays, signs and structures. The fourth Alcohol Misuse Enforcement Campaign (AMEC4) will take place in the month prior to the commencement of the World Cup. Operators can expect a higher than normal level of enforcement activity with visits from enforcement authorities. The key issues are likely to be whether Premises Licence Summaries are on display, their conditions are being adhered to, and obviously issues of underage and drunkenness. Management and staff should be vigilant on these issues in any event but particularly so during this period.
The arrival of the new campaign coincides with what appears to be a U-turn by LACORS in terms of the revised Code of Practice on Test Purchasing. It now seems that test purchasers will be allowed to lie about their ages if asked, which is contrary to what had been previously indicated. I have previously mentioned the issue of whether Premiership matches may be shown during the “closed period” between 2.45pm and 5.15pm on a Saturday afternoon. This followed a decision at Bolton Crown Court when a licensee had his conviction overturned.
The Court in that case did not go as far as saying that the FA Premier League were not entitled to take legal action to protect their interests under copyright law. As previously mentioned, all current prosecutions are continuing.
Nonetheless, following the decision a company in Stockport was sending out leaflets to licensees stating that the decision in this case made the televising of live Saturday afternoon Premiership fixtures legal. It was offering to put a system into premises showing games through Saudi Arabian television with English commentators. Apparently some licensees may have taken up the offer.

| BLANKET BAN AND HIGHER FINES! |
A White Paper on Health was published in November 2004 and it threatened the imposition of a smoking ban in public places including licensed premises by the end of 2008. The Government is now hoping to introduce a total ban within the next 18 months which would be in the summer of 2007.
All of this arises from a Valentine’s Day vote on the issue where 453 MPs voted in favour of a blanket smoking ban with 125 against. The previous suggestion had been a division between those pubs which were food led and those which were not. In addition, there would be an exemption for private members clubs. The vote was in favour of a total ban in all such venues regardless of food provision, private member’s status or anything else.

| Smoking Ban Comment - Beacon |
Beacon, the largest purchasing organisation for the independent hospitality trade in Britain, says that the majority of its members are likely to react positively to the news that a blanket ban on smoking in all enclosed public spaces in England is now on the cards.
Claire Bennett, Marketing Manager for Beacon, says: “Research with our members, which include over 2000 pubs, bars, hotels and restaurants, showed that there was a great deal of support within the industry for a complete ban.
“In fact 65% of the independent hospitality businesses we surveyed thought that a smoking ban was a good idea and a third of the businesses questioned had actually already introduced a smoking ban or were currently considering doing so.
“The feedback that we received also indicated that the majority of business felt that a total ban would be the most workable solution.

| CAN TEST PURCHASERS LIE ABOUT THEIR AGE? |
This has been mentioned in several previous eNews over the last couple of months. This is clearly something which is of great concern to the trade and undoubtedly of interest to prosecuting authorities.
The legal position under Section 146 of the Licensing Act 2003 is that someone commits an offence if he sells alcohol to an individual under the age of 18. There is a statutory defence if:
He believed that the individual was aged 18 and over; and
Either - (i) he had taken all reasonable steps to establish the individual’s age, or (ii) nobody could have reasonably suspected from the individual’s appearance that he was aged under 18.
It would be difficult to establish that you had taken all reasonable steps to establish someone’s age if you had not asked for identification.

It’s a historic day – well tomorrow is anyway. At one minute past midnight tonight the new Licensing Act comes into force. This means that any premises which had to close at 11.00pm with 20 minutes drinking up time can re-open at midnight provided that under the new Licensing Act they can trade through to 1.00am, 2.00am or whenever. Most of your customers may be journalists looking for a good story, but hey, you can do it if you want to. I suspect it won’t be until this weekend that the majority of premises start to trade late. It therefore seems a good time to remind you all of your duties under the Licensing Act 2003.
Section 57 of the Licensing Act 2003 puts a duty upon the holder of the licence to ensure that the licence, or a certified copy of it, is kept at the licensed premises. | Responsible Alcohol Drinks Retailing (NCRAR) – New BIIAB Qualification |
The BIIAB has developed a new qualification in response to demand from the industry and its regulators to provide an assessed training programme for full and part-time staff working in all licensed premises. A replacement for the Barpersons National Certificate, the qualification is pan-retail and suitable for all areas of the licensed sector.
The issue of responsible drinks retailing has featured heavily in the press, resulting in heightened consumer awareness of the issue at the same time as sharpening the trade’s understanding of their responsibilities. In response to growing concerns in the industry, the BIIAB has structured their Level 1 Award in Responsible Alcohol Retailing to cover:
1. The nature of alcohol, the common measurements of alcohol content and the effect that it has on the human body
2. The main issues in the 2003 Licensing Act as they relate to alcohol retailers and servers

This has already started! The vast majority of police forces across the UK will be taking part in the latest campaign targeting underage drinking and alcohol related disorder.
The campaign is due to run from 14 November 2005 to 24 December 2005 although many forces have not lost momentum since the last campaign.
Not only will police officers and Trading Standard officers be involved in test purchasing exercises but there is also a suggestion that covert filming will be taking place of youths involved in alcohol related disorder. Given the timing, it is undoubtedly the case that the police will be taking the opportunity to check that premises are complying with the terms of new Premises Licences under the Licensing Act 2003.

| Renewed blitz on test purchasing |
The Home Office has confirmed that there will be another blitz on licensed premises with regard to underage sales in the run up to Christmas. This follows the summer campaign where many licensed premises sold alcohol to under eighteens.
Once again it is important to make sure that your staff are fully trained with regard to underage sales. This training must also be documented. As licensee you can be convicted for the actions of your staff and this could have a detrimental effect upon your availability to hold a Personal Licence.
The Violent Crime Reduction Bill is also looming whereby three or more sales to underage people in a three month period could lead to closure of your premises for a specified period of up to three months.

| DRC pledges to get tough on access offenders on the high street |
On the eve of the first anniversary of new laws to make buildings more user-friendly to Britain¹s disabled people, the Disability Rights Commission has revealed that one in two complaints about the legislation concern leisure and retail high street businesses.
Responding to the findings, Bert Massie, Chairman of the Disability Rights Commission (DRC), said:
³We¹ve got a very simple message for those high street businesses that are dragging their feet. The DRC will vigorously pursue offenders through the courts. We are already taking legal action against two major leisure and retail providers and have a hit list of several others to follow. Laws to make business and services more user-friendly for disabled people have been on the statute book for ten years and there really is nowhere to hide anymore. To be doing very little for your disabled customers is no longer an option.²

National training company Sierra Training is this month flying the flag for security workers, asking Employers “Has your workforce been trained to the required standard for licensing yet?”, in a bid to combat the anticipated training bottleneck, or even worse, bout of prosecutions that may occur, on the back of new government regulations.
After 20 March 2006, it will be a criminal offence for any private sector security officer to operate without a licence. EqualIy, it will be a criminal offence for directors and managers of guarding companies to supply unlicensed operatives.
The SIA does not anticipate any period of discretion, and failure to licence individuals in time doesn’t merely mean that officers will be committing offences, but that the managers who deploy them will be committing a more serious offence, which is arrestable.

| No place for 'cancer rooms' in pubs |
The TUC has welcomed indications that the Cabinet today (Thursday) will
agree to ban smoking in all pubs - whether or not they serve food - but is
calling on ministers not to introduce new attempts at a compromise such as
allowing pubs to have 'cancer rooms' where drinks are not served but patrons
can light up.
TUC General Secretary Brendan Barber said: "We very much welcome the news
that the Cabinet is likely to scrap the unhappy compromise of allowing pubs
that do not sell food to allow smoking. Ministers deserve credit for
listening to unions and health campaigners who have said that all staff and
customers should be protected from second hand smoke. This will save up to
fifty lives a year. A ban on smoking in workplaces will go down as both a
great health and safety advance and a public health breakthrough.
